Law only indicates particular state in particular time. If someone got married many years ago but separated more than five years ago, they are married only just on paper but their married status is not recognised as legally married in common law in Japan's precedents. In this case if the one challenged his marital status to a court, divorce is sure to be admitted by a court.
I believe this reflects the spirit of law well.
